Large family: what types exist and requirements to obtain your degree

Are you waiting for a new child and will you become a large family? Has your personal situation varied and do you think you may be entitled to the title?

We tell you the requirements to apply for the large family title, until when it can be renewed and what categories exist according to the number of children that form the family unit.

Who are large families?

According to Law 40/2003, of November 18, on the Protection of Large Families, a large family is considered to:

  • The family consisting of one or two parents and three or more children, whether common or not.

  • The family consisting of one or two parents with two children, whether common or not, provided that at least one of the children has a disability greater than 33%, or is unable to work.

  • The family formed by two parents with disabilities and with two children, when one of the parents has a total degree of disability equal to or greater than 65%, or both a degree of disability greater than 33%, or is (are) unable to work .

  • A separated or divorced father, with three or more children even if they are in different family units.

  • A widowed father with two or more children.

  • Two or more orphaned brothers of father and mother under guardianship, in foster care or guardianship.

  • Three or more orphaned brothers of father and mother, over 18 years (or two if one of them is disabled) who live and depend on them economically.

Different categories

According to the number of children, large families fall into two categories:

  • General. Family unit consisting of three or more children, or two children if one of them or one of the parents has a disability. Also in the case of a widowed parent with two children.

And is that each child disabled or unable to work, counts as two.

  • Special. With five or more children, or with four children, of which at least three come from childbirth, adoption or multiple permanent or pre-adoptive foster care.

In order for family units with four children to be classified in the special category, the annual income divided by the number of members that comprise them, must not exceed 75 percent of the current interprofessional minimum wage (900 euros per month), including extraordinary payments.

How is it requested?

Article 5 of the Law for the Protection of Large Families establishes that:

  • The condition of large family will be accredited by the official title, which must be requested by a parent or guardian in the autonomous community of residence.

  • Both the issuance and renewal of the card is the responsibility of each community, although it is valid throughout the national territory.

  • It must be requested in the province where you live, through the Office of Attention to Large Families (if any), any Office of Civil Registry or in the office that the Ministry of Social Affairs has arranged in the Community for this purpose.

In most of the Communities, as documentation is only required, the application with the required data, the ID of the parents and the family book to issue the title and individual cards for each family member.

How long is the title valid?

Article 6 of the Law for the Protection of Large Families states that:

  • The title of a large family must be renewed (or remains without effect) when the number of members of the family unit or conditions varies, and it implies a change of category or the loss of the status of a large family.

  • The title will remain in force, although the number of children who meet the conditions to be part of the title is lower than the one established in each category, while at least one of them meets the following conditions:

    • Be single and under 21 years of age, or be disabled or unable to work, regardless of age.

    • The age limit is extended to 25 years of age, "When they take studies that are considered appropriate to their age and degree or aimed at obtaining a job".

    • Living with the father or mother, when they have divorced. It is understood that "the temporary separation by studies, work, medical treatment, rehabilitation or other similar causes does not break the coexistence between parents and children".

    • Depend financially on parents. This is when the child does not have an annual income higher than the current interprofessional minimum wage, including extraordinary payments. Also if the young person is incapacitated for work or contributes to the support of the family, when there is only one unemployed father.

The validity of the title members of the family unit will be understood exclusively to continue fulfilling the conditions to be part of it and It will not be applicable to children who no longer meet them.
